Defendant: Ibtihal Abriush

 

Sentence:

On 6.8.18 Ibtihal was convicted on a charge of grievous terrorism act.

 

The judge described in details the events that took place at Al Arub College.

(See earlier reports on Ibtihal’s case).

The judge noted that the defendant used a sizable rock in her attempt to hit Ofer Ohana, but in fact Ohana was unharmed, while she herself was pushed to the ground. The judge added that Ohana’s interrogation was not conclusive and deserved further examination. One could not ignore the lead up to the event, as detailed in the deliberations: Ohana’s conduct contributed significantly to the agitation and it included verbal and physical violence toward the accused.

 

The prosecutor, too, in his summation, agreed that Ohana’s behavior was reprehensible.

 

The judge stressed that the accused did not act out of ideological or nationalistic motives (a very important distinction when considering punishment – N. A.)

 

Sentence:

4 months prison time (from the day of arrest)

10-month probation for 4 years, so she does not repeat the offense.

1500-shekel fine.

 

The prosecutor asked for delay of execution. The accused was arrested on 25.4.18 so she will be eligible for release on 25.8.18.

However, there is an option of ‘administrative reduction” which means that she can be released immediately.

 

The prosecutor wanted her to remain in custody until a repeal is submitted.

 

After a long deliberation, the judge decided that a 72-hour detention is warranted.

Update from 14.8.18:

 

Atty. Samara confirmed that a repeal has in fact been submitted.

The hearing took place today.

 

Decision: release against 4000-shekel deposition.

 

Atty. Samara added that Ibtihal will indeed be released today!
