In today’s docket there are hearings of 3 detaineesinfo-icon and one  hearing in absentia regarding prohibition of meeting with attorney. The three are charged with the same violation: involvement in a terror attack at Eyn Bubin.

Two detainees (Bassel and Nizam) had identical hearings with identical decisions.

 

I report on one case, since the proceedings were so similar.

 

Bassel Raefat Jameel Waeskha – ID 859715922

He was born on 12.8.95 and resides in Beir Zait.

He is suspected of belonging to a military outfit, practicing shooting, dealing with combat materiel and taking part in an attack at Ein Bubin on 23.8.19.

 

Bassel was arrested on 25.9.19.

He is represented by Atty. Maamoun Hashim.

 

The investigator requests 10 additional days to complete the investigation and transfer the case to the prosecution.

This is Bassel’s 6th remand extension.

The investigator objects to publicizing the shooting allegation and asks to conduct the hearing behind closed doors in accordance with a gag order.

The defense objects to a gag order on the protocol, arguing that the investigation is about to conclude: the prosecutor is about to inform the court that the case is going to the prosecution. He adds, “We have reached an agreement for an 8-day remand.”

 

After examining the investigation material and the secret reports, the judge decides on an 8-day remand to conclude the investigation and hand the case over to the prosecution.

Nizam Sami Yusuf Alwad Muhammad – ID 403625908.

Born: 17.5.98.

Resident of Dura.

Arrested on 25.9.19.

Represented by Atty. Hader Daibas.

 

Hearing and decision same as in Bassel’s case.

Asrar Khathem Rashid Maouraf – ID 403993017

Born: 22.1.99.

Resident of Ein Kinia.

 

Suspected of taking part in the attack on Ein Bubin, dealing in combat materiel and aiding and abetting a hostile organization.

 

The investigator requests 8 additional days to complete the investigation. There is agreement between the sides on 4 more days. This is the detainee’s seventh remand extension.

The investigator requests a closed-door hearing.

 

After examining the file and the secret reports the judge determines that the allegations are warranted and decides on 4 additional days.

As for the gag order: having heard both sides, she finds no reason to bar publication.
